INTRODUCTION TO PROCEEDINGS
Presentation of the Arbitrations'
proceedings
For greater convenience, the proceedings proposed
by the Arbitration Chamber of Paris have been classified into three
groups entitled “Institutional Proceedings”, “Associated Proceedings”
and “External Proceedings”.
1/ Institutional
proceedings
We can find in this first group, the arbitrations governed
by :
1.
The Rules
of the Arbitration Chamber of Paris ,
which are the standard rules of the Arbitration Chamber of Paris.
These rules are applied when no other rules have been specified
by the parties in their contract ;
The scale of arbitration costs
applicable with the rules of the Arbitration Chamber of Paris, depends
on the nature of the dispute :
-
disputes of a general nature (any dispute except those mentioned
below) : application of the general
scale
-
business or raw material transformation dispute : application
of the
general
scale
. (if
there is a doubt, it is suitable to question the Arbitration Chamber
Office).

Since the first of March 2001 the Arbitration Chamber of Paris
offers a Mediation-Conciliation procedure : ( Mediation-Conciliation

2.
The
CAP-ACAREF Arbitration Rules ,
instituted in 1998 with the “Association de Conciliation, Médiation
et Arbitrage Régionale des Experts-Comptables Franciliens” are to

in partnership with the Association of Industrial Property Attorneys,
are intended to be applicable in all domains of intellectual property.

These
four rules have in common the fact that they have all been developed
by the Arbitration Chamber of Paris, in partnership with the concerned
organizations.
2/
Associated
Proceedings
The
associated proceedings are tied to specific fields for which the
Arbitration Chamber handles the organization of the arbitration
proceedings by applying rules inherent to the fields in question.
It
concerns :
-
The rules
of the International Seed Trade Federation (FIS), applicable
to international seed trade disputes ;
-
The ASSINSEL rules devoted
to controversies linked to the research and creation of rights relative
to methods and results of plant improvements ;
-
The rules
of the “Réseau Européen d’Arbitrage et de Médiation” (European
Network for Dispute Resolution), whose field of activity is the
resolving of cross-border disputes that do not exceed € 100.000.
3/
External
Proceedings
External
Proceedings refer to :
1.
The international arbitrations regulated
by the United Nations Commission for International Trade Law (UNCITRAL).
2.
The ad hoc arbitrations, for which the Arbitration
Chamber of Paris proposes its services and its experience to arbitrators,
who execute their mission in a non institutional way.
