The modernisation of the Energy Charter Treaty (ECT)

On July 28, 2021, a webinar will be held hosted by the Energy Dispute Arbitration Center (EDAC), an institution located in Ankara, Turkey, that specialises in the resolution of disputes related to energy and infrastructure projects.

This conference is part of a major reflection on the Energy Charter Treaty, which began in November 2017 at the initiative of the Energy Charter Conference, a body whose main prerogatives are to ensure the cooperation and modernisation of the energy sector of member States.

On November 27, 2018, the Conference validated the various themes of reflection proposed by a working group, which met on numerous occasions and was able to consult a panel of diverse stakeholders including observer countries and industry representatives. This list of topics, which is now the subject of the eight rounds of negotiations scheduled to take place until November 2021, includes the redefinition of the concepts of investment and investor, investment protection standards, the clause relating to regional economic integration organisations, and the right to regulate.

These reflections are particularly acute at a time when the question of the European Union’s position regarding the Treaty is increasingly debated, as is the compatibility of the Treaty with recent efforts to achieve an energy transition.

An ambitious round table, organised in partnership with the International Arbitration Chamber of Paris, will address these issues with a panel of experts in the field.
